Car Repossession Turns Into Assault by Gun

Inside the Police Reports: A livid Lilburn man takes out his pistol when two repossession agents attempt to take away his car.

A livid Lilburn man took out his pistol when two repossession agents attempted to take away his car earlier this month.

On the evening of Sept. 7, two representatives from a repossession agency in Conyers arrived at a home on the 600 block of Bruce Way near Killian Hill Road in Lilburn. According to the Gwinnett County police report, they were there to repossess the homeowner's car, a red 1992 Toyota Camry.

One of the representatives, a 32-year-old woman, entered the vehicle with a key she had. The car owner, a 40-year-old man, came running out of the home, yelling at her. She informed the owner what agency she was with and that she was there to repossess his car.

Despite what she said, he continued to scream and say that she was not taking his car.

According to the police report, the woman said the man told his kids to go inside the house and grab his pistol. He then decided to get it himself while his kids banged on the windows of the car, she told officers.

As she tried to pull the car out of the driveway, she said, the man's 20-year-old son grabbed her arm to stop her. She was able to pull away, the report says, but then the father came out of the home with his gun, a small, silver Bryco Arms .25 pistol.

She said that he pointed the gun at her and told her to get out, and she complied, calling police to the scene afterward.

The other repo agent, a 39-year-old man, said he was in the driveway the entire incident and confirmed his co-worker's story, from the son grabbing the woman's arm to the pistol to the kids banging on the windows. Once the gun was out and pointed, the male agent attempted to calm everyone down while his co-worker exited the car to dial 911.  

The father denied certain parts of the agents' story. According to the report, he thought someone was trying to steal his car, especially since no one showed him any paperwork for the repossession. He admitted to getting his pistol, says the report, but he never threatened or pointed it at anyone. 

The son denied grabbing the woman's arm, saying that he wasn't sure why she would make up something like that, the report says.

Police took the pistol from the father and put it away as evidence. A tow truck came to remove the vehicle for the repossession company.

Neither the son nor the father were arrested. Both parties were informed that the case would be forwarded to investigators.
