Inside the Police Reports: 'You Going to Jail Now'

A Lilburn man claims a driver in his neighborhood pointed a gun at him after he tried to talk to him about his speeding.

A man claimed to police that a driver in his neighborhod pointed a gun at him after he tried to talk to him about his speeding.

According to the Gwinnett County Police report, the complainant, 43, told authorities that he always sees a man in a black Honda speeding up and down his street on Rolling River Drive in Lilburn. It's gotten so bad that the driver almost hits children playing in the road, he added.

He tried to confront the other man, a 27-year-old who lives on the same street, when he was flying down the road one day last week.

He told police that the driver acted less than civil and instead pulled out a black pistol, "cocked it back," and pointed it at him.

The unarmed man surrendered with his hands up and walked back to his driveway, and the driver sped off again.

Police attempted to speak with the driver at his house, but after knocking on the door multiple times and announcing themselves, the officers received no response. One of the officers then spoke on their car's loud speaker, which prompted the man to finally emerge from the backyard.

While in handcuffs, the driver told authorities that he and the other man have had a lot of problems in the past. According to him, his neighbor always throws items at his car and yells at him.

That day, the older man apparently jumped in front of his car so fast that he had to slam on his brakes.

The pedestrian began to yell and point his hands in a "threatening manner," according to the report, so the driver grabbed his handgun from the glove box and placed it on the seat. He never pointed it at the other man, he said.

The man in the street cursed and yelled, "You going to jail now," and went back to his house. So the driver continued home and started fishing, he said.

The uncle of the older man told authorities that he saw the two talking, but he never saw a gun.

Because of no other witnesses, police determined there was no probable cause to make an arrest.
