Lilburn Man in Custody After Monday Morning Shooting

Police say victim is boyfriend of suspect's estranged wife

Gwinnett Police have arrested a Lilburn man for an early Monday morning shooting that left the boyfriend of his estranged wife in critical condition.

Maxwell Nyetrae was arrested Monday night and charged with aggravated assault, aggravated battery and possession of a firearm during the commission of a crime, according to police. He is being held in the Gwinnett County Jail without bond.

After responding to a call around 1:30 a.m. Monday, police found a man lying in the roadway at 1355 Tree Trail Parkway in unincorporated Norcross. The man had been shot in the back.

The man, who was transported to a local hospital in critical condition, told police that he had been visiting his girlfriend and when he left her apartment he noticed that his car had a flat tire.

He told police that as he tried to fix the flat, he was shot in the back by a man he identified as Nyetrae. The victim said that Nyetrae is his girlfriend’s estranged husband.

Gwinnett Police said Nyetrae had been been arrested previously (in November) for aggravated stalking against his estranged wife. Police also said that Nyetrae had been released from jail on a probation violation 48 hours before the shooting.

Gwinnett Police took Nyetrae into custody at his home in the 5200 block of Birdlake Drive in Lilburn.
