Happy Independence Day !

The 4th Amendment rocks. The 22nd is half-assed.

Happy 4th everyone! I was just wondering what your most favorite and least favorite amendments to the United States Constitution are?

My favorite amendment is the 4th (Search and Seizure). The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

This guarantees many of the liberties that we take for granted in the USA, that are not guaranteed in most other countries. More than any other entry, however, this one requires an independent and non-political judiciary to work for everyone.

My least favorite amendment is the 22nd (Presidential Term Limits). No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.

The amendment was a purely political one, a reaction to FDR’s four terms. By no means am I against term limits, quite the contrary. What I am against however, is applying term limits to the Executive while members of the Legislature can effectively serve for life. If anything, the founders envisioned quite the reverse. It was George Washington who created the two term precedent while FDR acted otherwise, but doing so only because of an existential national emergency. It's time to apply term limits to all Federal office holders, don't you think?
