Judge Drops DUI Charge in Lilburn Hit-and-Run

Spencer Todd Prigmore still has several felony charges against him in connection to crashing into a mother and daughter walking on Highway 29.

The driver arrested in connection to the fatal hit-and-run in Lilburn last week has had the DUI charge temporarily dismissed in the case, according to media reports. 

Spencer Todd Prigmore, 43, of Lilburn, appeared in magistrate court at 8:30 a.m. Thursday (July 25) for a hearing, according to Gwinnett County court records. Police arrested him last week in connection to killing a mother and daughter with a car while they were walking on the sidewalk on Lawrenceville Highway. 

On Thursday, Lilburn Police presented in court that they believe Prigmore was under the influence of some type of drug because he was hysterical and crying when they first detained him, the Gwinnett Daily Post reported

Prigmore's attorney, Thomas West, reasoned that his client's reaction was because he hit two people with his car and there's no proof he was under the influence. According to Lilburn Police, the suspect had denied a sobriety test at the scene but had blood drawn at the police station after investigators obtained a search warrant. His blood was submitted to the Georgia Bureau of Investigation's Crime Lab for testing.

While the DUI charge has been dismissed temporarily, it can always be added later. Currently, Prigmore still is charged with two counts of first-degree vehicular homicide, hit-and-run and failure to return to the scene.
